Call to Order:

At approximately 7:05 PM, Judy Watson, Chairman called the Planning Board Meeting to order.

Old Business:

Approval of August 15, 2005 Minutes:

Kenn Kern made a motion that we approve the Minutes of August 15, 2005. Lee Phillips seconded the Motion. All ayes. Motion carried.

New Business:

Application #2005-08 - John Dickquist - Special Permit & New Business Permit:
Judy Watson said John Dickquist will not be present tonight. There was miscommunication, as the hearing is supposed to be for a Use Variance before the Zoning Board of Appeals, and Mr. Dickquist must make another application.

Zoning Revisions:

Judy stated she has been meeting weekly with Brian Frazier, who is Director for the County Planning, as well as Greg Auleta, Chairman of the Zoning Board, with regard to changes in the Zoning Regulations. She stated there were a lot of regulations that were not in the original Zoning Regulations, and we would like to address these points. The secretary has sent to each member, six articles so far. They are not marked with any specific article numbers, as we do not know how it will end up when it is all put together. This is the second part of the Comprehensive Plan. Right now in the original Zoning Regulations, there is nothing about cell towers. Lee Phillips questioned about putting up a bond for the cell towers.

Judy told the members to please go over the revised regulations and mark any comments with a red pen. She said there will be more packets coming, as the Committee meets every Thursday.

Judy had some comments on the packet marked "Building Permits". On the second page - Demolition Permits - Purpose - "The Town contains certain structures of historical and/or architectural merit." She is looking for a definition for historical. Under "Permit required", it states "No residence or commercial structure or barn, or a portion thereof over the age of 50 years, may be demolished without a demolition permit having been first obtained". She question the 50 years. She stated perhaps 100 years old. Fran stated there are quite a few historical buildings in the town, some being 150 years old. Judy said we should put a question mark on demolition permits.

Fran Dellamano stated we should not have the regulations complicated. Keep them simple. It is for the health and welfare of the town.

Another article Judy questioned was "Fire Prevention and Building Construction". Under "Administration and enforcement", it mentions Code Enforcement Officer and Fire Marshal. We do not have a Fire Marshal. We should take out Fire Marshall wherever it appears.

The next item - Comprehensive Plan - "The Town of Oswego Comprehensive Plan, as amended from time to time". In the middle of that page "Permitted incentives", Judy had a question on E "Reduction of road construction standards applied under Chapter___, Subdivision of Land, for example, permitting a slightly narrower pavement width to serve a limited development project". Steve Greene stated that any changes made should be in the Subdivision Rules. Judy said we should take "E" right out of there.

It was questioned what SEQRA stands for. Steve Greene stated "State Environmental Quality Review Act.

Kenn Kern question 2 approves on Page 10 G(1). One "approve" should be taken out.

Compliance with SEQRA. It says "The applicant will submit an Environmental Assessment Form, Part 1 to the Town Board after the referral by the Planning Board". Judy says this is basically all the stuff we do, when we get done with it, it goes back to Theresa and the Town Board.

Somewhere in here, Judy found reference to who would be the lead agency, that it should be the Planning Board. Steve stated it is on Page 9, number 3.

The next item would be "Plan Review". It states "Following receipt of a favorable decision by the Town Board". - It should state "Planning Board".

Judy referred to "Land Acquisition" - "Purpose", and she wanted the members thoughts on it. Fran stated that the city and the state are buying up a lot of farm land. Fran questions what it is doing in zoning. He said Judy should bring it up at the next committee meeting. We could have houses built close together, but they have to give open space in another area, like a park.

Under "Procedure" "C" "Public hearing by the Town Board". It should read "Public Hearing by the "Planning Board".

Judy commented on Adult Business. She said she heard a rumor that someone wants to start an adult business in Swiss Village, called Satin Kitten.

Judy Watson received a letter from the New York State Office of Parks, Recreation and Historic Preservation, and she quoted:

"Dear Ms. Sabin-Watson

Thank you for requesting the comments of the Office of Parks, Recreation and Historic Preservation (OPRHP). We have reviewed the project in accordance with the New York State Parks, Recreation and Historic Preservation Law, Section 14.09

Based on this review, it is the OPRHP's opinion that your project will have No Impact upon cultural resources in or eligible for inclusion in the State and National Registers of Historic Places.

If further correspondence is required regarding this project, please be sure to refer to the

OPRHP Project Review (PR) number noted above.
