called to order by Chairman Jeff Boyer at 7:04PM

Motion to accept minutes of the July 20, 2009 meeting by Barry Pritchard.

Jeff told that Hannah’s * was contacted by Wayne Newton (CEO) in reference to their signage being on a NYS Right of Way (104W). They need to contact Jamie Tompkins, NYS DOT, 963-3730
Jeff explained that there is a law suit against the Town pertaining to the United Group project on Johnson Rd. The law suit claims that the Planning Board was not rigorous enough in their assessment and approval of the Site Plan with the addition of the sewage treatment plant. The law suit contends that we should open it up to a Public Hearing because it is a large enough change in the scope of the project. The Town has hired Sugarman Law firm and they are putting together a response to the law suit. The hearing is tentatively set for early September. Noreen & I went down to Steve Greene’s office to give documents and a timeline back to 2007.
Francis Dellamano questioned whether the firm was told that there was a discussion at the Planning Board meeting. Jeff said they were informed of the discussion. Fran suggested the Town not spend the money fighting the law suit. Just say we were wrong and have a Public Hearing and start over again.
Barry – the Town has no choice in fighting the law suit.
Lee – what was the large enough change? The septic system?
Fran – that they build it for them.
Jeff – from the SEQR point of view, that was a large enough change in the scope of the SEQR that required further review. Now, the response will be that we are seeking our experts, Barton and Loguidice, to get their input and it is based on their input. The worse that will happen is that B&L will review it and we will have to review the Site Plan.
Fran – hates to see the Town spending money to fight something like this.

Jeff – We need to pursue getting training. We should be getting information on free training. The County should be putting something together.

Fran – did you right a letter to Morris Sorbello?
Jeff – no, not yet.
Rick – ran into Dave Turner, spoke to him about the content of the letter from the County referencing Great Lakes Recycling. The Planning Board was looking for their help and advisement. Dave Turner said he did not mean anything negative, they did not have a comment.
Rick – is there a publication that provide training?
Fran – part of letter to Sorbello should concern training from the County, each year, in different parts of the County and times in the County because of convenience.
Jeff – majority of information, there is a fee involved. The County of Oswego will put together something for us for September, October time frame.
