Meeting called to order by Chairwoman Judy Watson at 7:00PM

Members present – Judy Watson, Gary Richardson, Barry Pritchard, Lee Phillips, Dr. Tesoriero, Kevin Caraccioli

Members absent – Michael Hagenmayer, Stephen Greene, Jr.

Motion to accept meeting minutes of March 21, 2011 by Barry Pritchard
2nd – Lee Phillips. Carried

Old Business

Kevin stated, for the record, that Michael Hagenmayer, has recused himself pending the determination of the United Group decision.

New Business

Kevin stated that at the last meeting, March 21, 2011, the SEQR Part II, in conjunction with Barton & Loguidice, was completed and copies have been submitted to the Board.

Some items, it has been determined, will create a large impact and Barton & Loguidice will address them in the SEQR Part III. Letter submitted by John Candido (attached).

Kevin proceeded to review each item.

John Candido submitted additional comments, supported by documentation by United Group, for the record.

Kevin stated that based upon this information, Barton & Loguidice have completed their review of the SEQR. Based on letter, from Barton & Loguidice, it is appropriate for the Board to adopt a Negative Declaration, no need for environmental impact statement.

Judy proceeded to read the description of the project, located at 2733 County Route 7 Johnson Road, Oswego, NY. Project is consistent with the Towns' Zoning Regulations. No environmental impact

Kevin stated that the documentation considered has been submitted by United Group throughout the project.

Rick Tesoriero asked if a traffic impact had been done.

John Candido stated yes.

Discussion among the Board as to the project in respect to the current Zoning Regulations.

Gary asked if the project went before the ZBA.

Kevin stated yes, a height variance was issued. Use consistent with apartment complex. Not a dormitory but an apartment complex. Opinion coming from Wayne Newton, CEO.

Public Comment – none Motion to table issue, pending determination, by Dr. Tesoriero.

Open Board Discussion – training available, for Board members, by Oswego County, May 17, 2011, 4:30-9:00PM, Oswego County BOCES.

Francis stated he is concerned with the traffic in the residential area of the United Group project.

Barry stated the Board should wait and see and let the Town deal with the problem

Judy stated she doubted there would be much travel by personal vehicle because of the parking situation on campus.

Kevin stated that an amendment of Local Law 1 of 2010, modified and clarified Local Law 1 of 2009.

Article 3.c – R-3 Residential District:

Allowed Uses: small multi family dwellings, apartments, planned unit development.

R-4 Residential District, includes apartment houses, etc.

Kevin stated the issue has been litigated.

Motion to withdraw "Motion to table" by Dr. Tesoriero.

Motion to adopt a Negative Declaration by Francis Dellamano.
2nd – Barry Pritchard. Carried.

Kevin stated that now the Negative Declaration, pertaining to the United Group project, can be filed with Albany. (copy attached)

Motion to adjourn by Lee Phillips at 8:00PM.
