Meeting called to order by Chair Judy Sabin-Watson at 7:03pm.

Members present: Judy Sabin-Watson, Francis Dellamano, Lee Phillips, Noreen Ruttan, Barry Pritchard, Richard Kaulfuss, Gary Richardson, Attorney Stephen Greene, Jr.

Others present: Greg Herrmann, Mike Blackwell, Patty Blackwell, Ann Moody

Public Hearing (Continued from July and August) - Eric Mills, 7764 State Route 104 – Barbeque Business
(Note: E. Mills not in attendance. None of the missing paperwork that was requested has been received). J. Sabin-Watson received phone call indicating that a revised application will be submitted. Suggested closing current public hearing for original application. R. Kaulfuss made motion to close public hearing; L. Phillips seconded. Carried. R. Kaulfuss made motion to deny application by Eric Mills. F. Dellamano asked if should be amended to add, due to (1) incomplete application, (2) has not reappeared, and (3) notification that individual will reapply. L. Phillips seconded. Carried.

Approval of August 20, 2012 Minutes: G. Richardson made motion to approve minutes; N. Ruttan seconded. Approved.

Old Business: J. Sabin Watson stated that she has received copy of letter from Sugarman Law Firm to Attorney Kevin Caraccioli referencing Dunsmoor vs. Planning Board claim: motion to dismiss is granted, and appeal is being dismissed, unless appeal perfected by 9/17/12.

New Business: J. Sabin-Watson stated that everyone went to training at Oswego High School. It was suggested that Comprehensive Plan needs to be working document. Town's Plan has no date to renew, and is about 8 years old.

Public Comment: P. Blackwell introduced Anne Moody who was never notified of Eric Mills' application. Also, what can neighbors expect going forward? J. Sabin-Watson said Board will have to wait to see what he presents.

Open Board Discussion: Discussions included Army Corp of Engineers involvement; Planning Board's and Code Enforcement Officer's roles for new businesses; Oswego Hots; Grace and Glory; and smoke regulations.

F. Dellamano made motion to adjourn; L. Phillips seconded. Carried.

Meeting adjourned at 7:26pm.
