The meeting of the Oswego Town Board was held February 13, 2006 at town hall. Supervisor Mullen opened the meeting at 7:00 PM with the Pledge of Allegiance; roll call was taken with the following members present:

The January receipts from the town clerk account was $712.00, $580.73 paid to the supervisor.

Supervisor's Report: Our 2005 books are closed, audited and have been submitted to the state comptroller I am happy to report that we have a healthy fund balance for both Highway and Town. During our administration we have never used any money from the fund balance for the operation of the town of Oswego or to balance budgets. The only funds expended were used to settle a law suit that the town lost back in 2002.

We finally have some money set aside for our highway equipment. Tonight we will be putting out to bid for a new snow plow to replace the 1976 that has needed many repairs this year. We have not purchased a new plow since 1999. In the next several years we are going to need another plow, a loader and a pickup. I have a 5 year plan to replace equipment. Just like in our own homes there are not many people who can plunk down cash for a new vehicle. The town will issue a BAN for the new plow and pay it off in the next 5 years using the equipment reserve to make the payments.

On tonight’s agenda there are two budget modifications. One is to put the insurance payment for damage at the HW garage that the town received in 2005 into the 2006 budget. The second is to pay the city for animal control costs that were not submitted until 2006.

After tonight the town will have a full board of ethics, something we have not had. We are thankful for our resident’s willingness to serve the town of Oswego.

Mrs. Peacock will be going out on maternity leave in March. Mrs. Kathleen DeWolfe will fill in on an as need basis.

The town will accept the resignation of Mrs. Patricia Blackwell from our Zoning board. We will advertise for a new member.

I would like to thank Mr. Carter and his department for their help moving things into the town hall.

We have begun hanging some art work from students from Mrs. Laurie Yule’s art classes at KPS. Take a minute to look at the children’s art. . Most people do not get into the schools to see the wonderful things our children produce.

Public Comment: Questions and concerns about the status of the Jim Hull clean up. What is the town boards intension regarding the clean up? Attorney Greene stated because the matter was in the hands of the court no comment could be made at this time.

Highway Superintendent Carter stated one of the plow trucks caught on fire today, no damage was sustained to the highway garage, and the battery had to be replaced in the truck.

Resolution 2006-29 Be it resolved the Oswego Town Board approves the minutes from the January 9, 2006 town board meeting.
Moved by Councilor Pritchard, second Councilor Mahaney All ayes motion carried.

Resolution 2006-30 Be it resolved the Oswego Town Board authorizes the following budget modifications to the 2006 town budget:

From A599 (appropriated fund balance) to A1620.4 (building-contractual)

In the amount of $11,508.52

From A1990.4 (contingent account) to A3520.4 (control of animals-contractual)

In the amount of $1,329.00.

Resolution 2006-31 Be it resolved the Oswego Town Board approves the bills on abstract 2.

Resolution 2006-32 Be it resolved the Oswego Town Board appoints JoEllen Smith to the Oswego Town Board of Ethics, and Lori Costo as an alternate. The town board thanks them for their willingness to serve the Town of Oswego. Appointments to expire December 31, 2006. Moved by Supervisor Mullen, second Councilor Herrmann.
All ayes motion carried.

Resolution 2006-33 Be it resolved the Oswego Town Board increases the town hall janitor line from $1775.00 to $3380.00. Moved by Councilor Pritchard, second Councilor Mahaney. All ayes motion carried.

Resolution 2006-34 Be it resolved the Oswego Town Board acknowledges the maternity leave of Mrs. Jennifer Peacock from approximately March 5, 2006 till May 29, 2006. The town board further acknowledges the appointment of Mrs. Kathleen DeWolfe as temporary clerk to the supervisor during Mrs. Peacocks leave at a rate of $12.00 per hour on an as needed basis.
Moved by Supervisor Mullen, second Councilor Herrmann. All ayes motion carried.

Resolution 2006-35 Be it resolved the Oswego Town Board directs the supervisor to sign an agreement with Combs and Lyons Forestry, to harvest timber on property owned by the Town of Oswego located at 2227 County Route 7, Oswego, tax map number 164.00-06-17.11. The town will be paid for the timber in the amount of $9700.00.
Moved by Councilor Pritchard, second Councilor Herrmann. All ayes motion carried.

Resolution 2006-36 Be it resolved the Oswego Town Board directs the supervisor to put out for bid a snow plow, specs to be given by the Highway Superintendent. Bid opening will take place March 6, 2006 at 6:30 PM at town hall.
Moved by Supervisor Mullen, second Councilor Herrmann. All ayes motion carried.

Resolution 2006-37 Be it resolved the Oswego Town Board directs the supervisor to purchase on state bid a 430 Case Skid Steer Loader with snow blower, price not to exceed $32,200.00. Moved by Councilor Pritchard, second Mahaney. All ayes motion carried.

Resolution 2006-38 Be it resolved the Oswego Town Board accepts with regret the resignation of Mrs. Patricia Blackwell from the zoning board. The town board wishes to thank her for her service to the town. Moved by Supervisor Mullen, second Councilor Mahaney. All ayes motion carried.

Motion by Councilor Mahaney, second by Councilor Pritchard to close the meeting at 7:18 PM.
