A meeting
of the Oswego Town Board was held on January 8, 2007 at town hall. Supervisor
Mullen opened the meeting at 7:00 PM with the Pledge of Allegiance. Roll
call was taken with the following members present:
Supervisor’s Report: We had a little sewer problem at Sleepy Hollow that was taken care of in a matter of hours, we all need to thank Councilors Herrmann and DeSacia for their can do attitudes as well as their hands on, and in, taking care of mattes that are very unpleasant. I would also like to thank Mr. Wilcox and our highway department for their help resolving problems at the plant. Our deputy Highway Superintendent Mr. Wilcox has been very busy getting things in order at the highway complex; he and his department have taken advantage of the good weather, clearing brush from the roads and cleaning the highway complex. Mr. Wilcox has many good ideas on how he thinks things should progress. I am very pleased with his willingness to cooperate, to communicate and to take ownership for the department. My clerk has been out sick for a week, I have taken on her responsibilities and I am happy to report she is on the mend and hopefully will be her old self very soon. We will be in the process of closing our 2006, and sending our books t the auditor for an audit and submission to the State Comptrollers office. Our dog control officer met with me on Saturday morning, he would like the town board to look over our Local Law on dog control. I have a copy for the board members and will look for their input on this before we set a public hearing on the matter. The supervisors from the towns of Oswego, Minetto and Scriba recently met with the Mayor of Oswego and Fire Chief Geers about ambulance service t the towns. We have asked and I believe will be granted an extension on our present contract until April ’07. I will have a full report at our next regular board meeting. Public Comment: None Resolution 2007-1 Be it resolved the Oswego Town Board approves the minutes from the December 11, 2006 and December 27, 2006 town board meetings. Moved by Councilor Mahaney, second Councilor DeSacia. All ayes motion carried. Resolution 2007-2 Be it resolved the Oswego Town Board approves the appointments found in Attachment A. Be it further resolved that these appointments shall run until December 31, 2007. Moved by Councilor Pritchard, second Councilor Herrmann. All ayes motion carried. Resolution 2007-3 Be it resolved the Oswego Town Board approves the schedule of salaries for elected and appointed officials and employees for 2007 found in Attachment B. Moved by Supervisor Mullen, second Councilor Mahaney. All ayes motion carried. Resolution 2007-4 Be it resolved the Oswego Town Board designates the Palladium Times as the official town newspaper. Moved by Councilor Pritchard, second Councilor DeSacia. All ayes motion carried. Resolution 2007-5 Be it resolved the Oswego Town Board designates JP Morgan Chase Bank, N.A. as the town’s depository for 2007. Moved by Supervisor Mullen, second Councilor Herrmann. All ayes motion carried. Resolution 2007-6 Be it resolved the Oswego Town Board imposes on the Supervisor powers and duties of administration and supervision of town or special improvement district functions to be performed on behalf of the town board. Moved by Councilor Mahaney, second Councilor Pritchard. All ayes motion carried. Resolution 2007-7 Be it resolved the Oswego Town Board establishes both a town clerk and supervisor’s petty cash fund of $100.00 each. Moved by Councilor Mahaney, second Councilor Herrmann All ayes motion carried. Resolution 2007-8 Be it resolved the Oswego Town Board approves the 2007 payroll schedule identified as Attachment C. Moved by Councilor Mahaney, second Councilor Pritchard. All ayes motion carried. Resolution 2007-9 Be it resolved the Oswego Town Board approves the holiday calendar identified as Attachment D. Moved by Councilor Herrmann, second Councilor DeSacia All ayes motion carried. Resolution 2007-10 Be it resolved the Oswego Town Board will hold monthly town board meetings the second Monday of each month, at 7:00 PM and a monthly workshop at 6:30 pm the first Monday of the month, both meetings will be held at the Oswego Town Hall. Moved by Councilor Mahaney, second Councilor Pritchard. All ayes motion carried. Resolution 2007-11 Be it resolved the Oswego Town Board authorizes the Supervisor to pay in advance of audit of claims for public utilities services such as gas, electric water, sewer, fuel oil and telephone service as well as for postage, freight, express charges and health insurance. Claims for these payments shall be presented at the next regular meeting for audit. Moved by Councilor Pritchard, second Councilor Herrmann. All ayes motion carried. Resolution 2007-12 Be it resolved the Oswego Town Board adopts the Code of Ethics as in Attachment E. Moved by Supervisor Mullen, second Councilor DeSacia. All ayes motion carried. Resolution 2007-13 Be it resolved the Oswego Town Board appoints Supervisor Victoria Mullen to serve as delegate t the 2007 NYS Association of Towns Annual Meetings. Moved by Councilor Mahaney, second Councilor Pritchard. All ayes motion carried. Resolution 2007-14 Be it resolved the Oswego Town Board adopts the Rules of Order of the Town Board of the Town of Oswego as found in Attachment F. Moved by Councilor Herrmann, second Councilor DeSacia. All ayes motion carried. Resolution 2007-15 Be it resolved the Oswego Town Board adopts the voucher calendar as listed in Attachment G. Moved by Supervisor Mullen, second Councilor Mahaney. All ayes motion carried. Resolution 2007-16 Be it resolved the Oswego Town Board hires Craig R. Gilbert Co. for yearly copier maintenance contract at a cost of $750.00. Moved by Supervisor Mullen, second Councilor Herrmann. All ayes motion carried. Resolution 2007-17 Motion by Supervisor Mullen and second by Councilor Herrmann to add items to the agenda. All ayes motion carried. Resolution 2007-18 Be it resolved the Oswego Town Board approves the bills on abstract 1.
Resolution 2007-19 Be it resolved the Oswego Town Board shall hold a public hearing on February 12, 2007 at 7:02 PM to hear all interested parties for or against amendments to the town dog law, Local Law 1-2003. Moved by Supervisor Mullen, second Councilor DeSacia. All ayes motion carried. Motion by Councilor Herrmann, second Councilor DeSacia to close the meeting of the town board at 7:15 PM. 2. Rule with respect to conflicts of interest. No officer or employee of a Town Agency or member of the Board should have any interest, financial or otherwise, direct or indirect, or engage in any business or transaction or professional activity or incur any obligation of any nature, which is in substantial conflict with the proper discharge of duties in the public interest. 3. Standards.

2. The Supervisor, immediately following the opening of every regular meeting of the Board, shall proceed to the regular order of town business as follows: Roll call, Town Clerk Report, Supervisor report, reception of petitions and other communications addressed to the Town Board, reports of committees, reports of officers and department, and introduction of resolutions and motions. 3. The Supervisor will hold a public comment prior to the resolutions and motions. At this time the public will be invited to comment. 4. Every resolution or motion must be seconded before being put to a vote by the Supervisor and all resolutions or motions shall be recorded in their entirety in the official minutes of the Town Board. 5. The Supervisor may offer or second a resolution or a motion and need not relinquish the chair for such purpose. 6. No motion or resolution may be brought to a vote except by the majority consent of those Town Board members present unless printed or typewritten copies thereof are presented to each member of the board 48 hours prior to the opening of the meeting at which such motion or resolution is offered. 7. No Town Board member shall speak more than once on any question until every Board member choosing to speak shall have spoken. 8. When a question is under debate, no motion shall be entered unless (a) for an adjournment or recess, (b) for the previous question to lay on the table, (c) to postpone to refer to a committee, or (d) to amend. These latter motions are neither amenable nor debatable. 9. No motion shall be made to offer an amendment to an amendment already before the Board on any proposition. 10. A majority vote of all the members of the Board shall be required to suspend these rules of order. A majority of the Board shall constitute a quorum. 11. If the above rules are or become at any time in conflict with the statutory law, the statutory law shall take precedence. 12. No member of the public shall engage in any demonstration, booing, hand clapping or otherwise disrupt the town board meeting. 13. Any person speaking to the town board with the consent of the supervisor shall address his/her remarks to the town board, no to the other members of the audience in the form of a debate or otherwise. 14. The public will be invited to comment on any motion or resolution not listed on the publicized agenda that is brought before the town board during a meeting. Attachment G:
