Board of Appeals meeting called to order by Chairman Greg Auleta at 7:20PM Present: Greg Auleta, Bob Dexter, Tim Anderson, Debra Jaskula Absent: Bob Baker, Kevin Caraccioli Greg read the Agenda with no comments. Accepted Greg asked for any comments or corrections concerning the February 19, 2009 minutes. Approved as written by Greg Auleta. New Business – Timothy LeRoy 2009-3 Area Use Variance Recess until 7:30. Reconvened at 7:30 – Public Hearing 2009-3 Called to order by Chairman Greg Auleta Application from Timothy LeRoy to construct an addition to his residence. CEO initially denied the application because of set back. Mr. LeRoy explained his plan including a 4 block foundation for a bedroom, baseboard heat. Record shows signed sheet by neighbors with no one raising any objection. (No neighbors present at Public Hearing). Greg Auleta – as an area variance this would be a front yard set back variance. Based on existing dimensions of the current home, the addition will need a 16’ variance. Variance will be 34’ from the road line. Discussion and Examination 1. Will this be detrimental to the health and safety of the general public or family. No 2. Can this benefit be achieved by any other means feasible to the applicant other than moving. No 3. No change in character of the neighborhood or nearby properties. No 4. Request is substantial. Yes 5. Will it adversely effect the environment. No. 6. Is it self created. No. Zoning Board Committee feels application itself has adequately answered the six questions that need to be addressed. Motion to grant an area variance for a road set back of 34’ in front of residence – Tim Anderson 2nd – Debra Jaskula. Greg Auleta – yes Tim Anderson – yes Bob Dexter – yes Debra Jaskula – yes Motion carried. Will go to Kevin Caraccioli for Resolution Old Business Greg – Town being re-zoned. The Zoning Committee will be meeting next week to address 4 or 5 issues that have been raised one being whether to have the County review any requests for septic systems, paving of property areas of 6 or more spaces, demolition permits (60 day waiting period). Zoning regulations are being expanded, more defined. Members advised of the October 5, 2009 training session by the County in Hastings. Being on the Zoning Board is contingent on taking part in these training sessions. Motion to adjourn – Tim Anderson 2nd – Bob Dexter.
